Welcome to Eluna Mind.
These Terms of Service ("Terms") govern your access to and use of the Eluna Mind website, applications, software, artificial intelligence features, subscriptions, and related products and services (collectively, the "Services").
For purposes of these Terms, "Eluna Mind," "we," "us," and "our" refer to the operator of the Eluna Mind Services.
Please read these Terms carefully.
By creating an account, accessing or using the Services, purchasing a subscription, or otherwise indicating your acceptance of these Terms, you agree to be bound by them and by our Privacy Policy, Cookie Policy, Refund Policy, and any additional terms presented to you in connection with a particular feature or purchase.
If you do not agree to these Terms, you should not use the Services.

About Eluna Mind

Eluna Mind is an AI-powered educational and productivity platform designed to help users study, learn, organize information, create educational materials, and work toward academic and career goals.
Depending on availability and your subscription plan, features may include AI tutoring, smart notes, flashcards, practice tests, citation assistance, grammar checking, paraphrasing, translation, lecture transcription, study planning, presentations, mind maps, career guidance, and other educational or AI-powered tools.
Features may be added, changed, limited, replaced, or discontinued as Eluna Mind develops.

Eligibility

You may use Eluna Mind only if you are legally permitted to enter into these Terms.
If you have not reached the age at which you can independently consent to the use of online services or processing of personal information in your jurisdiction, you may use Eluna Mind only with authorization from a parent or legal guardian where required by law.

Accounts

Certain features require an account.
You agree to provide accurate information and are responsible for maintaining the security of your account and credentials.
You may not sell, rent, transfer, or provide unauthorized access to your account.

Free and Paid Services

Eluna Mind may offer free and paid plans with different features, usage limits, AI access, storage, file-upload allowances, or other restrictions.
The applicable features and limits may be displayed on our pricing page or within the Services.

Subscriptions and Automatic Renewal

Paid subscriptions may be offered monthly, quarterly, annually, or on another billing basis.
Unless otherwise stated at checkout, recurring subscriptions automatically renew until cancelled.
By purchasing a recurring subscription, you authorize our payment processor to charge the applicable subscription price and taxes to your selected payment method at each renewal.
You may cancel future renewals through the cancellation options we provide.

Pricing, Payments and Taxes

Prices will be displayed before purchase and may vary based on plan, billing frequency, country, currency, promotion, platform, or applicable taxes.
Payments may be processed by third-party payment providers.
We may change pricing prospectively, subject to applicable notice requirements.

Cancellation and Refunds

Cancellation generally prevents future renewal and does not automatically refund an existing charge.
Refund eligibility is governed by our Refund Policy and applicable law.
Nothing in these Terms limits statutory consumer rights that cannot legally be waived.

Artificial Intelligence and Third-Party AI Systems

Eluna Mind incorporates artificial intelligence technologies and may rely on third-party artificial intelligence models, APIs, infrastructure, databases, search systems, and other technology providers to generate or assist in generating responses.
Although these technologies are designed to provide useful and accurate information, artificial intelligence is not infallible.
No AI-generated response should be assumed to be 100% accurate solely because it was generated by Eluna Mind or an underlying AI provider.
Even where information is generated or retrieved using reputable third-party AI providers, databases, APIs, or other information sources, errors may still occur.
AI-generated content may occasionally:

Contain incorrect factual information
Misinterpret a user's question
Provide incomplete information
Rely on outdated information
Produce incorrect calculations
Generate incorrect or nonexistent citations
Misidentify a source
Omit relevant context
Produce inconsistent answers
Contain information that appears convincing but is inaccurate
Contain errors originating from third-party AI systems, APIs, databases, or other external information sources

Accordingly, Eluna Mind does not guarantee that any AI-generated response is completely accurate, current, complete, reliable, original, or suitable for a particular purpose.
Users should independently verify information when accuracy is important, particularly before using generated content for assignments, examinations, research, applications, professional decisions, or other consequential purposes.
The use of third-party AI models, APIs, databases, or information sources does not constitute a guarantee or warranty by Eluna Mind regarding the accuracy of information produced through those systems.
To the maximum extent permitted by applicable law, Eluna Mind is not responsible for losses or consequences resulting solely from a user's reliance on inaccurate, incomplete, outdated, or otherwise erroneous AI-generated information.
Nothing in this section excludes liability that cannot legally be excluded.

User Responsibility for Verification

Eluna Mind is intended to assist users rather than replace independent judgment.
Users are responsible for reviewing and verifying generated information before relying on it.
Where a response involves factual claims, citations, calculations, dates, academic information, career information, or other important information, users should verify the response using appropriate authoritative sources.
A user's decision to copy, submit, publish, distribute, or otherwise rely upon AI-generated content remains the user's responsibility, subject to applicable law.

Academic Results

Eluna Mind does not guarantee grades, examination results, admission, scholarships, employment, internships, or other academic or career outcomes.

Academic Integrity

Users are responsible for following the academic-integrity and AI-use policies applicable to their school, university, professor, instructor, examination provider, employer, or other institution.
Eluna Mind must not be used for prohibited cheating, plagiarism, impersonation, fabrication of research, or unauthorized examination assistance.

Citation and Research Disclaimer

Citation and research tools are provided for assistance.
Users must verify important citations, sources, authors, publication information, URLs, identifiers, quoted material, and whether a cited source actually supports a particular claim.

No Professional Advice

Unless expressly stated otherwise, Eluna Mind provides educational and informational assistance and does not provide professional medical, mental-health, legal, financial, investment, tax, accounting, or immigration advice.

User Content

Users may submit prompts, documents, notes, images, lecture materials, assignments, study materials, and other content.
Users retain any ownership rights they already possess in their content.
By submitting content, users grant Eluna Mind the limited rights reasonably necessary to host, process, transmit, format, secure, and provide the Services.

Intellectual Property

Except for user content and third-party material, Eluna Mind and its licensors retain their rights in the Services, including applicable software, branding, interfaces, designs, databases, proprietary systems, and original materials.

Prohibited Activities

Users may not use Eluna Mind to violate applicable law, commit fraud, infringe intellectual-property rights, compromise security, introduce malware, obtain unauthorized access, circumvent subscription or usage restrictions, conduct unauthorized scraping, impersonate others, or otherwise abuse the Services.

Suspension and Termination

We may suspend or terminate access where reasonably necessary because of material violations of these Terms, fraud, security threats, illegal activity, serious abuse, unauthorized resale, payment failures, or legal requirements.

Third-Party Services

Eluna Mind may rely on third-party providers for AI, hosting, databases, authentication, payments, analytics, email, security, and other infrastructure.
Third-party services may experience errors, interruptions, changes, or outages outside our reasonable control.

Service Availability

We aim to maintain reliable Services but cannot guarantee uninterrupted or error-free operation.
Maintenance, updates, infrastructure failures, third-party outages, cybersecurity incidents, and other events may temporarily affect availability.

Changes to Features

Eluna Mind may add, improve, modify, replace, restrict, or discontinue features as the platform develops, subject to applicable law and applicable commitments relating to existing paid subscriptions.

Privacy and Security

Our handling of personal information is described in our Privacy Policy.
We may use reasonable safeguards designed to protect the Services and information processed through them, but no internet-based system can guarantee absolute security.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, Eluna Mind is provided on an "as is" and "as available" basis.
We do not guarantee that the Services or AI-generated content will always be accurate, complete, current, uninterrupted, error-free, original, or completely secure.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, Eluna Mind and its applicable owners, affiliates, personnel, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from or relating to use of the Services.
This may include, where legally permitted, losses associated with reliance on AI-generated information, inaccurate responses, incorrect citations, lost data, service interruptions, academic consequences, lost opportunities, or decisions made using generated content.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Consumer Rights

Nothing in these Terms is intended to waive mandatory consumer-protection rights available under applicable law.

Governing Law

Subject to mandatory rights that may apply based on a user's jurisdiction, these Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada.

Changes to These Terms

We may update these Terms as Eluna Mind evolves or legal requirements change.
Where required, appropriate notice of material changes will be provided.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, Legal Notice, and any applicable additional terms, form the applicable agreement governing use of Eluna Mind.
